The terms and conditions (Agreements) mentioned on this page govern your purchase, use, and access to any products and content provided by Night Vision, including all forms of CCTV cameras, firmware, and software. By ordering, purchasing, using, and installing our products or interacting with this website, you accept to be bound by the agreements mentioned on the terms and conditions. If you do not agree to any part of this, we urge you to reconsider using our website and purchasing our products. We shall not be held accountable for any discomfort should you not agree to the conditions mentioned here, yet still continue to use our website, softwares, and products.
Eligibility And Legal Capacity
By ordering or using Night Vision CCTV Cameras, you represent and warrant that you are of legal capacity – 18 years of age in Australia, and have the legal capacity to enter into this agreement. If you act on behalf of a business, an entity, or any form of third party, you accept that you are authorised to bind the said third party to the terms and conditions mentioned here.
Orders, Payments, and Formation of Contract
When you place an order for a product, you shall provide the billing, shipping, and payment information. By doing this, you accept that you are authorised to use the payment method provided.
Your order includes the offer to purchase. The purchase contract is formed only when we accept your offer, dispatch our product, and send you shipping confirmation. Please note that an order confirmation email alone does not account for the acceptance of the purchase.
Information such as pricing, taxes, shipping, handling fees, and any other charges shall be clearly provided during the checkout process. You shall agree to pay all the amounts due for the purchase as per the prices shown at the time of purchase. There shall not be any changes in the prices after the checkout – unless we provide you with discounts or other offers.
Consumer Guarantees, Warranty, and Returns
Australian Consumer Law and Guarantees
Night Vision is based in Australia, and therefore, all the sales are subject to the rights and obligations under the Australian Consumer Law (ACL). Therefore, some customer guarantees apply, which cannot be excluded or restricted as per the law. These guarantees include assurance that the products will be of acceptable quality, fit for the purpose for which they are designed, match their description, and comply with the sample or advertisement provided.
Warranty and Defects
In addition to the ACL guarantees, Night Vision provides a manufacturer’s warranty to cover defects in material and workmanship for a period of time from the date of purchase in accordance with our warranty period, which is 1 year. To be able to make a warranty claim, you are required to produce a receipt or an invoice showing the date of purchase. If requested, you may also be required to provide us with the original serial number or product packaging. Without these requested documents, we may reject the warranty requests.
Do note that our warranty does not cover damages caused by misuse, improper installation, third-party tampering, environmental damage (such as hail or heavy rain), unauthorised modification, wildlife damage, or regular wear and tear.
If a defect arises and you provide us with a valid claim within the warranty period, we shall repair, replace, or refund the purchase price at our discretion. Return and Refunds
Should you be unsatisfied with your purchase, you may return the product within the stipulated time (30 days of shipping), as long as it is unused, in original packaging, and with all the accessories, for a full refund or exchange.
After the stipulated time has passed, we only accept returns under the warranty policy or as required by the applicable law, such as customer guarantees.
Use of Products and Firmware / Software Updates
The product we provide may include associated firmware, software, and/or mobile applications. By using these, you accept that updates, patches, and upgrades may be delivered automatically to you with or without notice, depending on your preferences. These updates may be required to fix bugs, improve performance, maintain security, and provide you with new features.
You agree that Night Vision has the right to issue firmware and software updates. Continued use of your product after an update automatically signifies your acceptance of the updated software and terms.
Do note that Night Vision does not guarantee uninterrupted or error-free operation of the software or product. You assume all risks associated with use, including but not limited to loss of data, recording, or system downtime. However, we can assure you that we shall do our best to minimise the occurrence of said errors and bugs.
Intellectual Property
All the intellectual property rights associated with the product, software, documentation, website, content, user manuals, and trademarks are owned by or are licensed to Night Vision. These rights are protected by the relevant laws. Thus, you may not copy, reproduce, distribute, modify, reverse-engineer, decompile, disassemble, attempt to extract source code from the software, or replicate any forms of the product design or branding without any form of written consent from Night Vision.
Ownership of any product you pass on to you once we ship, and you take delivery. However, this does not provide you with any rights to patents, trademarks, copyrights, or trade secrets associated with Night Vision, beyond what is necessary for personal use.
Limitation of Liability
Except as mandated by law, including consumer rights, Night Vision does not guarantee anything more regarding the product than what is legally required.
This includes all warranties, expressed or implied, including but not limited to implied warranties of merchantability (legal promise that goods sold by a merchant are fit for their ordinary purpose and free from significant defects), fitness for a specific purpose, non-infringement, and quiet enjoyment.
We do not guarantee that the products or software will meet your requirements, or that they will operate uninterrupted or error-free.
In no event shall Night Vision or our officers, agents, employees, suppliers, or distributors be liable for any form of incidental, indirect, special, consequential, or punitive damages. This includes but is not limited to loss of profits, data loss, loss of recordings, loss of privacy, or other loss arising out of or related to your use or inability to use the Products or Software.
This limitation of liability applies regardless of the legal theory (contract, tort, negligence, strict liability, or otherwise).
User Responsibilities and Prohibited Use
By using products and software from Night Vision, you agree not to:
- Use them for any unlawful, fraudulent, or malicious purpose.
- Tamper with, disassemble, reverse-engineer, modify, or attempt to hack the Products or Software.
- Use Products in a way that violates privacy, data protection, or similar laws (e.g., unauthorised surveillance, distributing recordings without consent).
- Use the Products to infringe any third-party rights, including intellectual property or privacy rights.
- Offer deceptive or inaccurate information to Night Vision.
You are solely responsible for the correct installation of the products and securing your devices, taking reasonable care to secure recordings or captured data.
Privacy And Data Collection
If our products and services collect any form of personal data, such as recordings, metadata, and usage statistics, the collected data shall be governed by our Privacy Policy. By using our products and services, you confirm that you have read, understood, and accepted the terms mentioned in our Privacy Policy.
Notices and Communications
Night Vision may send notices, emails, updates, or other communications to any email address you provide at purchase or account registration. Notice is considered given when sent, even if not received.
You should keep your contact information up-to-date and are responsible for any failure to receive communications due to obsolete or incorrect contact info.

Governing Law and Dispute Resolution
The agreement and any disputes related to the terms and conditions mentioned here are governed by the state of New South Wales, Australia, without reference to conflicts-of-law rules.
Should there be any disputes which cannot be resolved through mutual negotiation within 30 days of written notice, the dispute may be submitted to binding arbitration before a mutually negotiated body or a lawful body.
However, you may still pursue a claim under applicable consumer protection laws (such as the ACL) if those rights apply and cannot be excluded by contract.
Assignment; Severability; No Waiver
Night Vision may transfer, assign or subcontract any or all of our rights and obligations under this agreement without your consent. You shall not transfer your rights or obligations under this agreement to anyone else unless Night Vision agrees to such transfer in writing. Even if parts of the terms and conditions mentioned here are found to be invalid, the rest of the terms shall remain valid and enforceable.
Do note that a failure or delay to enforce a rule does not mean a waiver of the said right or provision.
Changes to These Terms
We may update or modify the terms and conditions mentioned here at any time. The updated terms shall be effective from the date mentioned at the start, besides the “last updated” section. If the changes are significant, we shall inform you via means such as email or through an announcement on our website. Continued use of our Products after such changes constitutes acceptance of the revised Terms.
Entire Agreement
This Agreement, together with our Warranty Policy and Privacy Policy, constitutes the entire agreement between you and Night Vision with respect to the subject matter hereof and supersedes all prior or contemporaneous communications, agreements, or understandings, whether oral or written.
